Licence and terms of use

These terms apply to the ESMH Gantt Planner for Microsoft Excel and Google Sheets (“the planner”) and to this website. The planner is made by E.S.M.H Consulting FZE (“ESMH”, “we”, “us”). By downloading, copying or using the planner, you agree to these terms.
1. Editions
The planner comes in a Free edition and a Pro edition. We also make custom-branded versions for individual customers. What each edition includes is described on the home page.
2. Free edition licence
The Free edition is free of charge. You may use it for personal and commercial work, including planning projects for your clients and sharing the plans, PDFs and reports you make with it.
You may not:
- redistribute, resell, rent, sublicense or publish the planner files or their code, whether changed or unchanged;
- offer the planner, or a product based on it, as your own;
- remove or change copyright or licence notices in the files.
3. Pro licence
A Pro licence is per user: it lets one person use the Pro edition. The details of the licence, such as price and duration, are shown at purchase. The limits in section 2 apply to the Pro edition too.
If you upgrade from the Free edition with “Upgrade to Pro”, you keep your plan.
4. Custom builds
Custom-branded versions are built and licensed under a separate agreement with each customer. Where that agreement differs from these terms, the agreement applies.
5. Purchases, sign-ups and refunds
Free sign-ups and purchases are handled by Whop (whop.com). Whop’s own terms also apply to them. The price, and any refund terms, are shown on the product page when you buy.
Nothing in these terms limits rights you have under consumer law that cannot be excluded.
6. Your data
Your plans stay in your own file or your own Google account. We do not receive them. You are responsible for your data, including keeping backups.
7. What you need
The Excel version needs desktop Microsoft Excel 2016 or later, or Microsoft 365, for Mac or Windows, with macros enabled. It does not run in Excel on the web or on iPad. The Google Sheets version needs Google Sheets in a desktop web browser. Its menu and windows do not work in the Sheets apps for phones and tablets.
Microsoft Excel and Google Sheets are products of Microsoft and Google, which are not connected with ESMH. Changes they make to their products can affect how the planner works.
8. Ownership
The planner, its code, design and documentation belong to ESMH. Your licence lets you use the planner; it does not transfer ownership. Your plans and the content you enter belong to you.
9. Updates and support
We may release updates and fixes. We give support by email at gantt@esmhconsulting.com and do our best to help.
10. Provided “as is”
The planner and this website are provided “as is” and “as available”, without warranties of any kind, express or implied. This includes warranties of fitness for a particular purpose and of the accuracy of calculations. Check important dates, costs and figures before you rely on them.
11. Limitation of liability
To the extent the law allows, ESMH is not liable for any indirect or consequential loss, or for loss of profit, revenue, data or business, arising from the use of the planner or this website.
To the extent the law allows, ESMH’s total liability for any claim is limited to the amount you paid for your licence in the 12 months before the claim.
Nothing in these terms limits liability that cannot be limited by law.
12. Ending the licence
If you break these terms, your licence ends and you must stop using the planner.
13. Governing law
These terms are governed by the laws of the United Arab Emirates. The courts of the United Arab Emirates have jurisdiction over any dispute about them.
14. Changes to these terms
We may update these terms. The date at the top shows when they last changed. The version that applies to a purchase is the one in force when you buy.
